Please read these Terms carefully. By accessing or using fitzone.et (“fitzone.et,” “we,” “us,” or “our”), whether as a casual visitor or as a registered gym operator, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
Section 01
1. About the Service
fitzone.et operates a comprehensive digital directory of gyms, fitness centers, and athletic studios (“Gyms”) across Ethiopia. The platform facilitates discovery by aggregating information such as branch locations, operating schedules, pricing tiers, facilities, equipment, and photos (“Listing Information”).
For Visitors
Search and compare gym branches in your neighborhood without creating an account or paying any fees.
For Gym Owners / Operators
Create an account to submit, verify, and maintain branches, amenities, photos, and contact channels.
Important: fitzone.et is an information and discovery service only. fitzone.et does not own, operate, or manage any gym, does not employ fitness trainers or gym personnel, and is not a party to any membership agreement, workout session, waiver, payment, or contract entered into between a Visitor and a Gym.

2. Eligibility
To create a Gym Owner account or submit a Listing on the Service, you must be at least 18 years of age (or the age of legal majority in the Federal Democratic Republic of Ethiopia) and have the legal capacity to enter into binding contracts.
Visitors of any age may browse public gym listings. However, the Service is not targeted at children under the age of 18, and we do not knowingly solicit or collect personal information from minors.

3. Gym Listings, Owner Accounts & Media Rules
3.1 Accuracy of Information
If you create an account and submit or manage a Listing, you represent, warrant, and covenant that:
You are the lawful owner, authorized operator, or legal representative of the listed facility;
All submitted data (branch names, phone numbers, location coordinates, hours, amenities, and prices) is accurate, current, and truthful;
You will promptly update your listing whenever operating schedules, prices, or facilities change.
3.2 No Guarantee of Accuracy for Visitors
While fitzone.et strives to present verified information, we do not independently inspect every gym facility daily.fitzone.et makes no representations, warranties, or guarantees regarding the accuracy, timeliness, or completeness of any listing.Pricing, monthly packages, daily passes, operating hours, and trainer availability must always be confirmed directly with the gym before you travel or make payments.
3.3 Strict Content & Photography Standards
Critical Photography & Privacy Rules for Gym Operators
Gyms are sensitive personal spaces. When uploading photos of your facility, you must adhere strictly to the following standards:
Strict Privacy Areas: You must never upload photos or videos depicting locker rooms, changing quarters, showers, saunas, or restroom areas.
Model & Member Consent: You warrant that you have obtained all necessary permissions, consents, or model releases from any gym patrons, employees, or visitors visibly identifiable in your photos.
Intellectual Property: You warrant that you own or possess the necessary licenses to publish all logos, graphics, and promotional photos you upload.
3.4 Photo Notice & Takedown Procedure
If you are a gym member, visitor, trainer, or photographer and notice your photograph or copyrighted work published on a fitzone.et listing without your authorization, please contact us immediately at hello@fitzone.et with the listing URL and description of the image. fitzone.et will promptly review and remove non-compliant content.
3.5 Business Verification & Disputed Listings
fitzone.et reserves the right (but assumes no obligation) to request proof of legal business registration, trade licenses, or management authority from any gym operator. In the event of an ownership dispute (e.g., competing claims between business partners or unauthorized listings), fitzone.et reserves sole discretion to suspend, reassign, or delete the listing pending resolution.
3.6 Fees & Future Services
Basic gym listing and directory search on fitzone.et is currently free. Should fitzone.et introduce premium placements, sponsored listings, or subscription features in the future, clear pricing and billing terms will be presented for your advance approval prior to incurring any charges.

4. Acceptable Use & Anti-Scraping Policy
You agree to use the Service exclusively for lawful purposes and in accordance with these Terms. You specifically agree not to:
Scrape or Harvest: Use bots, spiders, scrapers, crawlers, or other automated mechanisms to collect gym phone numbers, addresses, pricing, or photos from the Service without prior written authorization from fitzone.et (standard search engine indexing excepted);
Impersonate: Misrepresent your identity or affiliation with any fitness facility, company, or individual;
Interfere: Attempt to probe, scan, or breach our server security, bypass authentication, or disrupt website operations;
Fraudulent Listings: Create duplicate, deceptive, fictitious, or spam listings.

5. No Endorsement & Physical Safety Disclaimer
Physical exercise involves inherent risks of injury, dehydration, and bodily harm.
fitzone.et does not inspect, certify, endorse, or supervise any gym, gym equipment, sanitary conditions, or trainer qualifications. Your decision to visit a gym, engage in physical exercise, hire a personal trainer, or purchase a membership is undertaken entirely at your own risk.
fitzone.et expressly disclaims all responsibility and liability for:
Any bodily injury, illness, accident, or property loss sustained on the premises of any gym;
Any contractual or financial disputes between you and a gym operator (including refund claims, membership cancellations, or fee changes);
The professional competence or conduct of gym employees or independent contractors.
Section 06
6. Intellectual Property & Content Licenses
fitzone.et Intellectual Property: The Service, including our user interface, brand assets, code, typography, database schemas, and compilation of listings, is protected by copyright, trademark, and other applicable laws of Ethiopia and international conventions. You may not copy, reverse-engineer, or reproduce any part of our platform without prior written consent.
License to fitzone.et: When you submit gym names, descriptions, logos, branch photos, or schedules, you retain ownership of your content. However, you grant fitzone.et a perpetual, non-exclusive, worldwide, royalty-free, transferable license to host, store, display, format, publish, and promote such content across the fitzone.et website, search engines, and social media channels.

7. Third-Party Links & Map Tiles
fitzone.et includes links to external third-party sites (e.g., gym websites, Telegram channels, Instagram pages, or WhatsApp numbers) and incorporates mapping services provided by OpenStreetMap. We do not control or endorse external websites and are not responsible for their content, availability, or privacy practices.
Section 08
8. Termination & Suspension
We may suspend or terminate your access to your Owner account or remove any listing at any time, with or without notice, if we reasonably determine that you have violated these Terms, submitted fraudulent data, or engaged in conduct detrimental to the fitzone.et community.
Gym operators may deactivate or delete their account and associated branch listings at any time by contacting hello@fitzone.et.

9. Disclaimer of Warranties
THE SERVICE, INCLUDING ALL DIRECTORY LISTINGS, PHOTOS, AND SEARCH CAPABILITIES, IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FITZONE.ET DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL OPERATE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability & Financial Cap
To the maximum extent permitted by applicable law in Ethiopia, fitzone.et, its founders, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service or any gym facility discovered through it.
Aggregate Liability Cap: In no event shall fitzone.et's total cumulative liability arising out of or relating to these Terms or the Service exceed 1,000 ETB (One Thousand Ethiopian Birr) or the total amount paid by you (if any) to fitzone.et in the twelve (12) months preceding the event giving rise to liability, whichever is greater.

11. Indemnification
You agree to defend, indemnify, and hold harmless fitzone.et, its affiliates, and representatives from and against any claims, liabilities, damages, losses, and reasonable legal expenses arising from or in connection with: (a) your use or misuse of the Service; (b) any gym listing, photos, or data you submit; (c) your violation of these Terms; or (d) any dispute between you and any third party or gym patron.

12. Governing Law & Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Federal Democratic Republic of Ethiopia, without giving effect to any principles of conflicts of law.
Before commencing formal legal proceedings, both you and fitzone.et agree to attempt in good faith to resolve any dispute informally for a period of at least thirty (30) days by contacting hello@fitzone.et. If unresolved, any legal action or proceeding shall be brought exclusively in the competent courts located in Addis Ababa, Ethiopia.

13. Changes to These Terms
We reserve the right to amend these Terms from time to time. When revisions are made, we will update the “Last updated” date at the top of this document. Continued use of fitzone.et following the posting of amended Terms constitutes your agreement to the new Terms.
